The parties hereto agree that the following preliminary drawings and quantities are for the sole purpose of bidding the Individual Project, are not for final construction, and are not to be used for any other purpose without the Engineer’s written consent. These drawings and quantities are posted on this site pursuant to Client’s request or the request of a modular block manufacturer. If the Client does not intend to bid this Individual Project per the Engineer’s Preliminary Drawing and quantity, The Client, agrees not to reproduce, copy, modify, alter, or use the drawings and/or quantities, in original, modified or altered form and will immediately delete the drawing  and/or quantity. The parties hereto agree that the Client’s retention or use of the drawings and/or quantities, in original, modified or altered form, constitutes, the Client’s acceptance of the terms and conditions of the Preliminary Design Contract, and if awarded, the modular retaining wall contract, the Client shall enter into a Final Design Service Contract with the Engineer.
